Terms of use

These terms of use (the “Terms”) govern access to and use of the Figurative application and website (the “Service”), published by Peyrat Clément (Sole trader (entrepreneur individuel, EI) - French micro-enterprise), trading as “Nyters”. By creating an account or using the Service, you accept these Terms without reservation. If you do not agree to them, you must not use the Service.

Figurative is a tool for miniature painters that allows them to document and share painting recipes: photo annotation (pins and zones), management of a paint collection, searching for equivalences between brands, and sharing content within a community. The Service is offered in a free version; additional features are available through the “Pro” offering, available either as an annual subscription or as a one-off lifetime purchase, described in the terms of sale.

• Creating an account requires a valid email address and a username. You undertake to provide accurate information and to keep it up to date.
• You are responsible for keeping your credentials confidential and for all activity carried out from your account.
• The Service is not intended for people under 15. By creating an account, you declare that you are of the required age.

You retain ownership of the content you create and publish (recipes, photos, annotations, texts). By publishing content, you grant Figurative a non-exclusive, worldwide and free licence to host, reproduce and display that content for the sole purpose of operating and promoting the Service. You warrant that you hold the necessary rights to the content you publish and that it does not infringe the rights of third parties.

It is prohibited, in particular, to publish or distribute via the Service:

• unlawful, hateful, violent, defamatory or sexual content;
• content infringing the intellectual property rights of third parties;
• misleading content, spam or unsolicited advertising;
• any behaviour intended to disrupt the Service, circumvent its limits or compromise its security.

The Service provides a content reporting mechanism. The publisher may remove any content that is manifestly unlawful or contrary to these Terms and, where appropriate, suspend or delete the account concerned, in compliance with applicable regulations. Any unlawful content may be reported to contact@nyters.com.

You may stop using the Service and delete your account at any time. The publisher may suspend or terminate access in the event of a breach of these Terms. Deleting the account results in the erasure of your data under the conditions set out in the privacy policy.

The trademark, logo, interface, texts and code of Figurative are protected and remain the exclusive property of the publisher. Nothing in these Terms grants you any right over these elements, other than the right to use the Service in accordance with its intended purpose.

The Service is provided “as is”. The publisher endeavours to ensure its availability and security without being able to guarantee them uninterrupted. The publisher cannot be held liable for damage resulting from misuse of the Service or from content published by users. It is your responsibility to keep your own backups of your important content.

The financial terms of the Pro version - plans, price, term, automatic renewal of the annual subscription and cancellation - are set out in the terms of sale.

The publisher may amend these Terms. In the event of a significant change, you will be informed by appropriate means. The date of the last update appears at the top of this page.

These Terms are governed by French law. Failing an amicable resolution, any dispute falls within the jurisdiction of the competent French courts.
